The article provides a historical and legal analysisof the formation of the institution of citizens’property rights to residential premises in the ByelorussianSSR. In the period of 1917-1920, the institutionof property rights was practically abolished.With the beginning of the new economic policy, theprinciples of socialist property rights of citizens toresidential premises were formed, in which propertyownership, use and disposal combined freedom andrestrictions on the owner’s powers under the conditionsof the Soviet legal system
